Liability Waiver

RUN MENTOR LIABILITY RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE

I desire to run as a volunteer with “Mile in My Shoes” (MiMS), and in consideration of my acceptance as a volunteer, the undersigned hereby agrees and covenants as follows:
I desire to participate as a member in the activities of the MiMS running program (the “Activities”), and I fully understand and appreciate the dangers, hazards and risks inherent in the Activities and in any transportation to and from the Activities, which dangers could result in property damage, personal injury, illness or even death. I acknowledge that I have sole responsibility for my personal possessions and athletic equipment during my participation in the Activities.
Being advised of the dangers, hazards and risks of the Activities, and in consideration of being permitted to participate in the Activities, on behalf of myself, my family, heirs and personal representatives, I (the undersigned), agree and consent to assume and take upon myself all the risks and responsibilities surrounding my participation in the Activities and any related transportation, including, but not limited to, falls, contact with other participants, the effects of weather, including high heat and/or humidity, the and conditions of the road and traffic during the course of any run, as well as contact with participants in the MiMS program who may suffer from mental illness or who may have criminal backgrounds, and agree to release, waive, forever discharge, and covenant not to sue MiMS or any of its officers, directors, members, volunteers, agents or representatives with respect to any and all liability for any harm, injury, damage, claims, demands, actions, causes of action, costs and expenses of any nature arising out of or related to any loss, damage or injury, including, but not limited to, suffering and death, that may be sustained by me or by any property belonging to me, whether caused by the negligence or carelessness of MiMS or otherwise, while I participate in or am in transit to or from the Activities.
I understand and agree that MiMS does not have medical personnel available at the location of the Activities. I understand and agree that MiMS is granted permission to authorize emergency medical treatment, if necessary, on my behalf and that such action by MiMS shall be subject to the terms of this Liability Release, Waiver, Discharge and Covenant Not to Sue. I further understand and agree that MiMS assumes no responsibility for any injury or damage which might arise out of or in connection with any such authorized emergency medical treatment.
It is my express intent that this Liability Release, Waiver, Discharge and Covenant Not to Sue shall bind the members of my family and spouse, if I am alive, and my estate, family, heirs, administrators, personal representatives and assigns, if I am deceased, and I further agree to save and hold harmless, indemnify and defend MiMS from any claim by me or my family arising out of my participation in the Activities.
I understand that MiMS reserves the right to terminate my participation in the Activities at any time if I do not adhere to MiMS policy, or if I breach any of my obligations provided for above, or if I have made any misrepresentation herein or otherwise.
I authorize and consent to the use of my name, and any photograph of me, without compensation to me of any kind, in promotional materials, broadcasts, telecasts, by the press, or in or by any other media of any kind, as the above may pertain to the Activities or MiMS.
In signing this Liability Release, Waiver, Discharge and Covenant Not to Sue, I acknowledge and represent that I have fully informed myself of the content hereof by reading it before I sign it, and that I sign it as my own free will without relying upon any other representation, statement or inducements, apart from the foregoing written statement. I also acknowledge that I want to participate in the Activities voluntarily, despite the possible dangers and risks and despite this Liability Release, Waiver, Discharge and Covenant Not to Sue.
I further state and represent that I am at least eighteen (18) years of age and fully competent to sign this Liability Release, Waiver, Discharge and Covenant Not to Sue; and that I execute this Liability Release, Waiver, Discharge and Covenant Not to Sue fully intending to be bound by the same. I further state that there are no health-related reasons or problems which preclude or restrict my participation in the Activities.
I EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE ACTIVITIES REFERRED TO ABOVE COULD BE DANGEROUS AND INVOLVE THE RISK OF SERIOUS INJURY AND/OR DEATH AND/OR PROPERTY DAMAGE.
I EXPRESSLY AGREE THAT THE FOREGOING LIABILITY RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE IS INTENDED TO BE AS BROAD AND INCLUSIVE AS LEGALLY POSSIBLE, AND THAT IF ANY PORTION THEREOF IS HELD INVALID THE BALANCE SHALL, NOTWITHSTANDING, CONTINUE IN FULL LEGAL FORCE AND EFFECT.
